Terms & Conditions — Gentree & ChatTree

These Terms and Conditions (“Terms”) govern your access to and use of the Gentree and ChatTree platforms, websites, applications, AI tools, form-builder services, QR-code systems, messaging features, and all related products and services provided by Gentree Pty Ltd (“Gentree”, “ChatTree”, “we”, “our”, “us”).
By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. Definitions
- “Platform” refers to Gentree, ChatTree, all custom apps created for clients, and all related digital services.
- “User” means any person accessing or using the Platform.
- “Client” means a business or organisation that subscribes to Gentree/ChatTree services.
- “Company Account” refers to the customised app and operational system created for a Client.
- “Forms” refers to digital forms, workflows, checklists, PDFs, AI-generated content, or submissions created through Gentree.
- “ChatTree” refers to the messaging component where chats automatically delete after 24 hours.
- “Content” includes all data, messages, files, uploads, images, and text submitted or generated through the Platform.
2. Eligibility
To use Gentree or ChatTree, you must:
- Be at least 16 years old, or
- Have permission from a parent/guardian or organisation, and
- Have the authority to act on behalf of a business (if registering a Company Account).
3. Account Registration & Security
When creating a Company Account or user login, you agree that:
- All information provided is accurate and kept up to date.
- You are responsible for maintaining the confidentiality of login credentials.
- You must notify us immediately if you suspect unauthorised access.
- You are responsible for all activity under your account.
Gentree may suspend or terminate accounts that violate these Terms.
4. Service Description
Gentree provides:
- Custom digital forms
- QR-code-based access
- PDF generation and automated email submissions
- AI-powered assistance
- A custom-branded management app for your organisation
- Ongoing form creation (based on your subscription level)
- Support and technical help
- ChatTree messaging with 24-hour disappearing messages
ChatTree is designed for temporary communication only and is not intended to store or preserve historical chat logs.
5. Client Responsibilities
Clients agree to:
- Provide accurate content for forms and app setup.
- Ensure their users comply with these Terms.
- Use the platform in accordance with all applicable laws, including WHS, privacy, and employment laws.
- Not upload harmful, illegal, or inappropriate content.
Clients are solely responsible for:
- The accuracy of form content
- Their internal compliance
- Their business processes
- How they use the platform to manage staff or operations
Gentree is not responsible for business decisions made using the platform.
6. AI Tools & Generated Content
Gentree may provide AI-powered features (e.g., Codey, ChatTree AI).
By using these tools, you agree that:
- AI output is informational only, not legal or professional advice.
- You are responsible for reviewing and verifying AI-generated forms, content, or recommendations.
- We do not guarantee the accuracy or completeness of AI output.
Your inputs and outputs remain confidential and are not used to train public models.
7. ChatTree Messaging Terms
ChatTree provides 24-hour disappearing messages.
You acknowledge that:
- Messages permanently delete after 24 hours.
- Deleted messages cannot be recovered.
- Gentree may access a chat only for technical or support purposes.
- ChatTree must not be used for critical record-keeping or compliance documentation.
Users must not:
- Harass, abuse, threaten, or misuse the messaging system.
- Share illegal or inappropriate content.
- Upload viruses or malicious files.
8. Payments, Billing & Subscriptions
- Pricing is listed on our website or agreed upon in a service contract.
- Subscriptions automatically renew unless cancelled.
- Clients are responsible for payment on time.
- No refunds are issued for partial billing periods.
- Custom development or additional work may incur extra fees.
Gentree reserves the right to change pricing with reasonable notice.
9. Intellectual Property
Gentree and ChatTree logos, systems, AI prompts, form builder, and all associated software remain the property of Gentree Pty Ltd.
Clients own:
- Their own business data
- Their uploaded content
- Their custom forms (unless using templates provided by Gentree)
Clients grant Gentree a licence to use their content only for:
- Operating the platform
- Troubleshooting
- Technical improvement
- Providing customer support
We do not sell or share your content with third parties.
10. Prohibited Conduct
Users must not:
- Attempt to hack, copy, reverse-engineer, or disrupt the platform
- Use the service for illegal activities
- Share login details with unauthorised users
- Misuse the AI system to generate harmful content
- Infringe on intellectual property rights
- Upload harmful data or malware
Violation may result in account termination.
11. Data Protection & Privacy
Your use of the platform is also governed by our Privacy Policy.
Key points:
- Data is encrypted and securely stored.
- ChatTree messages delete after 24 hours.
- We follow Australian Privacy Principles (APPs).
- You may request data deletion (subject to legal obligations).
Gentree takes reasonable steps to protect data but does not guarantee absolute security.
12. Service Availability & Updates
We aim to provide uninterrupted access, but:
- We may perform updates or maintenance.
- Service interruptions may occur due to technical issues.
- Features may change or be updated without notice.
We are not liable for downtime, loss of access, or interruptions.
13. Limitation of Liability
To the maximum extent permitted by law:
Gentree is not liable for:
- Loss of business, revenue, or profits
- Loss of data (including deleted ChatTree messages)
- Errors or omissions in AI-generated content
- Decisions made based on forms, templates, or app content
- Delays or service interruptions
- Any indirect, special, or consequential damages
Clients are responsible for ensuring their operational and compliance requirements are met.
14. Indemnity
Clients agree to indemnify and hold Gentree harmless from claims arising from:
- Misuse of the platform
- Inaccurate or illegal content submitted by the client
- Violations of these Terms
- Actions taken by users under the client’s Company Account
15. Termination
We may suspend or cancel accounts if:
- Payments are overdue
- Terms are violated
- Misuse or illegal activity is detected
- A client requests cancellation
Upon termination:
- Access to the platform stops
- Data may be deleted in accordance with our retention policy
- No refunds are issued unless required by law
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia, unless otherwise required by your jurisdiction.
Any disputes will be handled within NSW courts or appropriate tribunals.
17. Changes to These Terms
We may update these Terms from time to time.
The latest version will always be available on our website.
Continued use of the platform means you accept any revised Terms.
